On December 16, 2019, the use of Automatic On-Board Recording Devices or AOBRDs will no longer be allowed under Federal Motor Carrier Safety Administration regulations. Motor carriers currently utilizing an AOBRD, must install an Electronic Logging Device to their power unit before December 16, 2019.
While much of the industry switched over to ELDs by the April 1, 2018, hard enforcement deadline, there were still some stragglers. Those who used automatic onboard recording devices (AOBRD) prior to the Dec. 17, 2017, soft enforcement deadline were still able to continue doing so until now. The deadline is December 16, 2019, for all drivers using AOBRDs to convert to ELDs.AOBRDs and ELDs are alike in the fact that they both record a driver’s hours of service, however, the primary difference between ELDs and AOBRDs is that ELDs have proven to track more information more accurately. For example, an ELD can identify information on a driver’s change in duty status, logging in and out, location information, and ECM data such as engine power status, vehicle motion, and system malfunctions.Additionally, there are differences in edit history capabilities, where ELDs have a greater level of accuracy and HOS compliance. ELDs readily display log edit history—for review by DOT inspectors, for example—whereas AOBRDs do not.There are some key requirements and resources that might assist you in making the transition from AOBRDs to ELDs. The Agency encourages motor carriers to be proactive, inform yourself, and maintain compliance.All motor carriers that do not utilize ELDs after the respective compliance dates, will be placed out-of-service (OOS). There will be no “checkbox” on the FMCSA website to ensure compliance, it is a standard requirement of doing business, like insurance, creating a sense of urgency for these updates and encouraging everyone to switch to ELDs as soon as possible.These laws will soon take effect and it is crucial for everyone to comply in their respective sense. Failure to do so will be punishable and could result in an immense impact to every organization involved.
